1. Acceptance of Terms

By accessing and using OutfitVideo ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

These Terms of Service ("Terms") govern your access to and use of our website, services, and applications (collectively, the "Service") operated by OutfitVideo ("we," "us," or "our").

2. Description of Service

OutfitVideo is an AI-powered platform that generates short-form videos (5-10 seconds) from outfit images. Our service includes:

  • AI-powered outfit detection and analysis
  • Automated video generation with customizable styles and backgrounds
  • Video storage and secure download access
  • Credit-based pricing system with subscription and one-time purchase options
  • User account management and analytics

3. User Accounts

3.1 Account Creation

To use our Service, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2 Account Eligibility

You must be at least 18 years old to use our Service. By creating an account, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3.3 Account Security

You are responsible for maintaining the security of your account. You must immediately notify us of any unauthorized use of your account or any other breach of security.

4. Credit System and Pricing

4.1 Credit Usage

Our Service operates on a credit-based system:

  • 720p videos: 1 credit per second (e.g., 5 credits for a 5-second video)
  • 1080p videos: 2 credits per second (e.g., 10 credits for a 5-second video)
  • Credits are deducted when video generation is successfully completed
  • Credits are refunded if generation fails due to system errors

4.2 Free Trial

New users receive 5 free credits to try the Service. Free trial credits are subject to usage limits and cannot be used for certain video configurations. Trial credits are one-time only and cannot be transferred or refunded.

4.3 Subscriptions

Subscription plans provide monthly credits that reset each billing cycle. Unused subscription credits do not roll over to the next period. Subscription credits are separate from purchased credits.

4.4 Purchased Credits

One-time credit purchases never expire and can be used at any time. Purchased credits are non-refundable except as required by law or in cases of service failure.

4.5 Pricing Changes

We reserve the right to modify our pricing at any time. Changes to subscription pricing will be communicated to existing subscribers at least 30 days in advance and will apply to the next billing cycle.

5. Payment Terms

5.1 Payment Processing

Payments are processed securely through our payment processing partners. By making a purchase, you agree to provide current, complete, and accurate purchase and account information.

5.2 Billing

Subscriptions are billed in advance on a monthly or yearly basis. You authorize us to charge your payment method for all fees associated with your account.

5.3 Refunds

Refunds are provided in the following circumstances:

  • Video generation fails due to system errors (credits automatically refunded)
  • Service is unavailable for extended periods (pro-rated refunds may be available)
  • As required by applicable consumer protection laws

No Refunds for Used Credits: Refunds cannot be provided for credits that have been used to generate videos or regenerate model images. Once credits are consumed, they have been utilized by our AI video and image generation systems, which process your content through advanced machine learning models. These computational resources are consumed during the generation process and cannot be recovered or reused. This policy applies to all credit usage, including video generation and model image regeneration.

Refunds for subscription cancellations are provided on a pro-rated basis for the unused portion of the billing period, unless otherwise stated. Unused credits remain in your account and can be used at any time.

5.4 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. You will continue to have access to the Service until the end of your paid period.

6. User Content and Intellectual Property

6.1 Your Content

You retain all ownership rights to the images you upload and the videos generated from your images. By using our Service, you grant us a limited license to:

  • Process your images through our AI systems to generate videos
  • Store your images and generated videos on our servers
  • Use anonymized, aggregated data for service improvement and analytics

6.2 Generated Videos

You own the videos generated from your images and have full commercial usage rights. Generated videos may be used for any purpose, including commercial use, without watermarks or attribution requirements.

6.3 Prohibited Content

You agree not to upload or generate content that:

  • Violates any laws or regulations
  • Infringes on intellectual property rights of others
  • Contains hate speech, harassment, or discriminatory content
  • Is pornographic, sexually explicit, or inappropriate
  • Depicts violence or illegal activities
  • Contains personal information of others without consent

We reserve the right to remove any content that violates these terms and suspend or terminate accounts of repeat offenders.

6.4 Our Intellectual Property

The Service, including its design, features, functionality, and AI models, is owned by OutfitVideo and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or create derivative works of our Service without our express written permission.

7. Service Availability and Modifications

We strive to provide reliable service but do not guarantee uninterrupted or error-free operation. We reserve the right to:

  • Modify, suspend, or discontinue any aspect of the Service at any time
  • Perform maintenance that may temporarily interrupt service
  • Update features, pricing, or terms with reasonable notice
  • Limit access to the Service for users who violate these Terms

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUTFITVIDEO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

9. Indemnification

You agree to indemnify, defend, and hold harmless OutfitVideo and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any rights of another party.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including:

  • Violation of these Terms of Service
  • Fraudulent, abusive, or illegal activity
  • Non-payment of fees
  • Extended periods of account inactivity

Upon termination, your right to use the Service will immediately cease. We may delete your account and associated data, except where retention is required by law.

11. Dispute Resolution

Any disputes arising from or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of [Arbitration Organization], except where prohibited by law.
